1. Acceptance of Terms

By accessing the GuestConnect platform, creating an account, or using any of our services, you acknowledge that you have read, understood, and unconditionally accepted these Terms of Service, as well as our Privacy Policy and Cookie Policy.

If you are using GuestConnect on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms. In such cases, 'you' and 'your' refer to that entity.

GuestConnect reserves the right to modify these Terms at any time. Changes take effect upon publication on the platform. For material changes, we will notify you by email or in-app notification at least 30 days before the new terms take effect. Your continued use of the platform after notification constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using GuestConnect and delete your account.

2. Platform Description

GuestConnect is an online marketplace that connects travelers with hosts offering accommodations, providers offering services (transport, cleaning, laundry, concierge, etc.), and organizers offering local experiences (tours, activities, gastronomy, etc.). GuestConnect is not a party to contracts concluded between travelers, hosts, and providers.

GuestConnect acts exclusively as a technical intermediary. As such, GuestConnect does not manage, own, control, or provide the accommodations, services, or experiences listed on the platform. GuestConnect does not guarantee the quality, safety, legality, or accuracy of offers published by hosts and providers.

GuestConnect reserves the right to modify, suspend, or discontinue all or part of the platform at any time, with or without notice, without liability to you or any third party.

Access to certain platform features may require creating an account and/or paying a subscription. Available features may vary depending on your account type (traveler, host, provider) and your geographic location.

3. User Accounts

To access all GuestConnect features, you must create an account by providing accurate, complete, and up-to-date information. You agree to keep this information current throughout your use of the platform. Any false or misleading information may result in immediate account suspension or deletion.

You are solely responsible for the confidentiality of your login credentials (email address and password) and all activities carried out from your account, whether authorized by you or not. You agree to immediately notify us at security@guestconnect.io of any unauthorized use of your account or any other security breach you become aware of.

Each user may only hold one active personal account. Creating multiple accounts to circumvent restrictions, suspensions, or bans is strictly prohibited and may result in the deletion of all accounts involved.

Host and provider accounts are subject to an identity verification process before activation. GuestConnect may request identity documents, proof of ownership, or other documents to verify provided information at any time. Refusal to provide these documents may result in account suspension.

You acknowledge that GuestConnect may deactivate your account at its sole discretion, including in cases of Terms violations, extended inactivity (more than 24 months without login), or at your express request.

4. Bookings and Transactions

A booking request constitutes a firm offer on your part to enter into a contract directly with the host or provider concerned, under the terms indicated on the listing at the time of the request. A booking is confirmed only after explicit acceptance by the host or provider and, where applicable, after payment validation.

You agree to carefully read the entire listing — description, photos, amenities, house rules, cancellation policy, and pricing terms — before making any booking. By confirming a booking, you declare that you have read and accepted all of this information.

Prices are displayed in the currency indicated on the listing. Additional fees may apply depending on the host's pricing policy (cleaning fee, security deposit, local taxes, GuestConnect service fee). The total amount to be paid, including all applicable fees, is displayed as a summary before booking confirmation.

GuestConnect collects service fees calculated as a percentage of the booking amount. These fees are clearly indicated at the time of booking and contribute to platform operations, payment security, and customer support.

Any request to modify a confirmed booking (dates, number of travelers, services) is subject to the host or provider's agreement. GuestConnect is not responsible for the refusal of a modification request.

5. Host and Provider Obligations

By publishing a listing on GuestConnect, you declare and warrant that you have the legal right to offer the accommodation, service, or experience in question, that you have all necessary authorizations, licenses, and permits required by applicable local regulations, and that your offer complies with applicable laws and regulations.

You agree to describe your offer accurately, honestly, and completely. The information provided (description, photos, amenities, location, availability, rates) must match reality at the time of booking. Any significant discrepancy between the description and reality may give rise to a traveler complaint and corrective action by GuestConnect.

You agree to keep your availability calendar up to date to avoid double bookings and last-minute cancellations. Repeated cancellations on your part may result in penalties, reduced visibility on the platform, or account suspension.

You are solely responsible for meeting your tax obligations related to income generated through GuestConnect, including declaring rental income and collecting applicable tourist taxes. GuestConnect may be required to transmit financial information to tax authorities in accordance with applicable legal obligations.

For services and experiences, you warrant that you hold the qualifications, certifications, and professional insurance required to carry out your activity and that your professional liability is covered.

6. Guest Obligations

As a traveler, you agree to use accommodations, services, and experiences booked through GuestConnect in accordance with the rules communicated by the host or provider and applicable local laws. You are responsible for leaving the premises in the condition you found them.

You agree to respect the host's house rules, including rules regarding check-in and check-out times, pets, parties, smoking, and the number of authorized guests. Non-compliance with these rules may result in immediate termination of the stay without refund.

You are responsible for any damage caused to the host's or provider's property during your stay or use of the service. GuestConnect provides a dispute resolution system to facilitate compensation in case of damage, subject to supporting evidence.

You acknowledge that GuestConnect does not guarantee the identity of hosts and providers or the quality of the offers listed. It is your responsibility to research and exercise your own judgment before any booking. Reviews and ratings published by other travelers constitute useful but non-contractual information.

7. Published Content

All content published on GuestConnect (text, photos, reviews, comments, messages) must be accurate, legal, and respectful. It is strictly prohibited to publish misleading, defamatory, obscene, discriminatory, violent content, content that infringes on others' privacy, or content that violates third-party intellectual property rights.

Reviews published on GuestConnect must reflect a real and authentic experience. Publishing fake reviews, fabricated testimonials, or content designed to artificially manipulate ratings is strictly prohibited and may result in legal action. GuestConnect reserves the right to remove any review it deems contrary to these rules, without prior notice and without obligation to provide justification.

By publishing content on GuestConnect, you grant GuestConnect a worldwide, non-exclusive, royalty-free, assignable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, and distribute this content as part of operating and promoting the platform. This license ends when you delete your content or account, unless the content has been shared with other users.

You represent and warrant that you own or have the necessary rights to publish the content in question and that this content does not violate any third-party rights. You agree to indemnify GuestConnect against any third-party claims relating to the content you have published.

8. Payments and Refunds

Payments made through GuestConnect are processed by PCI DSS-certified third-party payment service providers. GuestConnect does not store your credit card data. By making a payment, you accept the terms and conditions of the applicable payment provider.

Refunds are subject to the host's or provider's cancellation policy, as indicated on the listing at the time of booking. GuestConnect may offer additional protection to travelers in cases of serious non-compliance with the offer or last-minute cancellation by the host, in accordance with its traveler guarantee policy.

In the event of a dispute relating to a payment or refund, you must contact GuestConnect support within 14 days of the arrival date or service completion. GuestConnect will act as mediator and its decision will be final, subject to judicial appeal.

GuestConnect reserves the right to withhold all or part of the funds in the event of an active dispute, suspicion of fraud, or at the request of a competent authority. Funds will be released once the dispute is resolved.

9. Limitation of Liability

To the fullest extent permitted by applicable law, GuestConnect and its officers, employees, agents, partners, and suppliers disclaim all liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the platform.

GuestConnect's total liability to you for any claim arising from these Terms or your use of the platform is limited to the greater of (a) the amount of service fees collected by GuestConnect on the transaction(s) concerned in the 12 months preceding the event giving rise to the claim, and (b) 100 euros.

GuestConnect does not warrant that the platform will be continuously available, uninterrupted, secure, or error-free. GuestConnect also does not warrant the accuracy or completeness of information published by hosts and providers, or the suitability of offers to your particular needs.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such cases, the above exclusions and limitations apply to the extent permitted by law.

10. Suspension and Termination

GuestConnect may suspend or terminate your access to the platform, with or without notice, in the event of a breach of these Terms, fraudulent behavior, threats to platform or user security, repeated or serious complaints from other users, or upon request from a judicial or administrative authority.

If your account is terminated, current bookings are maintained until their natural end, unless the termination is motivated by behavior endangering other users' safety. You retain access to your personal data for 30 days following termination to allow you to export it.

You may terminate your account at any time from your account settings or by contacting GuestConnect support. Terminating your account ends your right to use the platform but does not affect rights and obligations that arose before termination.

Provisions of these Terms that, by their nature, are intended to survive termination (including sections on intellectual property, limitation of liability, indemnification, and dispute resolution) will remain in effect after termination.

11. Dispute Resolution

In the event of a dispute between a traveler and a host or provider, we encourage you to first attempt to resolve the dispute directly through GuestConnect messaging. If no amicable agreement is reached within 72 hours, either party may open a dispute case with GuestConnect support.

GuestConnect will act in good faith as a mediator, and its decision, rendered within 14 business days, will be binding on both parties regarding refunds and compensation transiting through the platform. This mediation does not prevent the parties from pursuing their case in the competent courts.

These Terms are governed by Beninese law. Any dispute relating to their interpretation or performance that cannot be resolved amicably will be submitted to the competent courts of Cotonou, Republic of Benin, subject to mandatory legal provisions applicable in your country of residence.
